License or Lease of Real Property
The university may license or lease real property to or from third parties on or off any FIU campus, subject to approval.
For short term use of FIU’s spaces (e.g., a one-day event in the Graham Center) managed through the university’s central reservation system EMS, the Central Reservation Office (CRO) has extensive resources and expertise and can assist both internal and external parties in securing that space. For spaces not managed through the university’s central reservation system, longer term licenses/leases no matter the funding source of the space (e.g., auxiliary, E&G, donation, etc.) and the use of non-FIU space, the Office of Auxiliary and Enterprise Development (AED) must be consulted and approve before units engage with external parties or the General Counsel’s Office.
To initiate the space use process, please complete the online form at https://go.fiu.edu/RE_REQUEST. This will provide AED with the information needed to support your request.
A member of the AED team will reach out and discuss next steps including drafting of documents, board materials, financial models, etc.
- If the lease or license agreement is approved, AED will work with the General Counsel’s office to draft a Premises Use Agreement (PUA) for FIU space or respond to a PUA for another party’s space.

- For long-term (i.e. greater than 1 Year) PUA’s, AED will collect the lease/license/PUA payments, remit the Florida sales tax and allocate a pro rata share of the revenues to cover PO&M and expenses incurred by unit in managing or supporting the terms of the contract.
Please note, no license or lease agreement can be executed without prior review and approval by AED, General Counsel, CFO, and if necessary, the Provost and President.
